How do i get my Domain Name back?

No long ago i did a search to be sure that the web-site address i wanted to launch did not already exist. Convinced that it wasn't existing, I went ahead to commission a web-site designer to register and design the web-site. I got the shock of my life some days ago when the designers told me that the name has been taken by a another person. My investigation revealed this "person" to be a site called "Domaincar" who specializes in using their computers to captures expired or pre-registered sites. Once you do a search, their system has a way of capturing that address (if it doesn't exist) and register it. I am completely disgusted at this. I have written to them to transfer back to me the domain name, but they are yet to reply. Already i have incurred great cost on publicity for this site and i would love to know HOW DO I GET MY DOMAIN NAME/WEBSITE ADDRESS BACK? All suggestions would be appreciated, because i know i am not the only person affected by this kind of unethical practice.

You must be the person who registered it. By not registering it you have no rights to it and in fact you did exactly what these sites want you to do and that is show an interest in a site so they can park on it. You should have used somebody like Netsol to search for the address and then any of the dozens of trusted registars to register it the second you thought you wanted that address.



Now if you still want to have that address you have to show that you have a claim to that site and the current owner is just parking on it. The process will not be easy and will not be quick. I would suggest writting back to this outfit and ask them what they think is a fair fee for the domain name. If they come back with a number you are unwilling to pay then I would write them back that you are going to file a complaint with ICANN and you have the documentation to show they are illegally parking on the domain. This will probably get you another offer from them. To give you an idea the last group I had do this wanted $3000.00 for the domain which then came down to $500 when I talked tough.

As the others say, you don't own the domain name as long as you don't register it. You could say "the domain name you wanted", but that's just semantics.



Unfortunately there are groups out there that somehow register names soon after they're searched for but haven't been taken. One group is Domaincar/Unasi, another is Kenyatech.



Until ICANN (http://www.icann.org), a Court of competent jurisdiction, or even a law (all of which are yeah right) draw the lines on this, we can expect this to go on and on. What makes it more difficult is that domain names have taken on worldwide implications, and how one issue is treated in country A may be handled differently in country B.



Hard lesson learned: search AND register the name immediately. Don't wait and don't hesitate, no matter what.

Pre-registered domains do get "stolen" to divert a flow of traffic. I'm sure you heard of expired domain traffic. Most likely, that company will never reply back as it may be in business for themselves knowingly doing so. Check with your guy and see what you could do, if you haven't already. If you have and still don't know what to do take some of these tips 1) findout your nameserver, what your hosting service is, any information on your website you pre-registered. If you already paid for all this, then you should have a username and password for your website and access to your hosting account. Your webmaster should know what to do and should be able to take care of this for you. 2) If all else fails, may I suggest coming up with a different website name?!

I hate to say it but if you didn't register it then you never "had it". For less then $10.00 a year and some places as low as $5.00 a year you should have registered it before you invested money.



If the company that registered it doesn't renew it their registration will expire in a year but I think your only alternative now will be to try to buy it from the company that registered it.

first try to see when ur domain name has been registered .

u say that ur domain name after ur search said that ur domain name does not exist

where did u find it out ?

u should have tried it at http://www.register.com

i wanted to register 2 domain names

i looked for them at register.com

after makin sure , it doesnot exist

i asked for it to be reigistered for me .

if u like a domain name , and register.com says that its been registered before , u shall wait till the domain name registration expires and u register it later , and u can ask who has registered it now , to sell it to ya .
